FREEDOM OF INFORMATION REQUEST REFERENCE NO: 547-2025
I write in connection with your request for information which was received on 19th May 2025 as follows:
Q1. I request under the Freedom of Information Act to see a list of incidents (asb/criminal offence/other) reported to Warwickshire Police that have taken place in St. Nicholas Park, Warwick (including the south side of the park to Myton Road) since 27th January 2024 to the present day. The list should comprise the following.
Date of incident.
Description of incident.
Where exactly in St. Nicholas Park did the incident take place.
Action taken by Warwickshire Police and outcome, if any.
Q2. I also request under the Freedom of Information Act to see a list of incidents (asb/criminal offence/other) reported to Warwickshire Police that have taken place in Pickard Street, Warwick, since 27th January 2024 to the present day. The list should comprise the following.
Date of incident.
Description of incident.
Action taken by Warwickshire Police and outcome, if any.
Just to clarify, I am requesting descriptions of each actual incident, not just classified under asb, criminal offence or other.

The numerical data presented below is an unaudited snapshot of unpublished data sourced from "live" systems and is subject to the interpretation of the original request by the individual extracting the data.
Q1 response: I can advise that the requested information is held; however, it is not suitable for disclosure in the requested format.
When refusing to provide information (because the information is exempt), Section 17 of the Freedom of Information Act 2000 requires Warwickshire Police to provide the applicant with a notice which:
(a) states that fact,
(b) specifies the exemption in question and
(c) states (if that would not otherwise be apparent) why the exemption applies.
The exemption applicable in this case is:
Section 40(2) Personal Information
Section 40 is an absolute class-based exemption, which does not require evidence of the harm disclosure would cause and does not require consideration of a public interest test. That being said, where Section 40(2) is engaged, in order to make the exemption absolute there needs to be evidence that a Data Protection Principle would be breached by disclosure.
This exemption is engaged where disclosure of information relates to personal data of a third party or could lead to the identification of an individual, either from that information alone or combined with any other information from within the Police Service or public domain. In this case, providing a list of each incident to include the date, details, action taken, and location, in direct correlation with each other, is likely to lead to the identification of an individual and provide personal information. Such a disclosure would breach an individuals’ rights under the Data Protection Act 2018, in particular Article 5(1) of the GDPR which states that personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject.
This letter serves as a refusal notice under Section 17 of the Freedom of Information Act in relation to the requested format. Instead, a breakdown of the number of incidents recorded has been provided broken down by month. The details of these incidents, locations and action taken have been presented in such a way that ensures no individual is identified and then provided broken down by year and in uncorrelated tables.
When considering the information below, please note that searches were conducted of the Command-and-Control System for any incidents, reported between 27th January 2024 and the date of your request, logged at landmarks within St. Nicholas Park. The resulting records are set out below; however, it should be noted that results are based on what has been recorded in the location details within the log and is dependent upon what the caller states and how the handler records it. In an event that there are other incidents reported relating to the relevant areas, but where the location has not been recorded as one of the landmarks within St. Nicholas Park, then these will not have been returned within the results.
