FREEDOM OF INFORMATION REQUEST REFERENCE NO: 23-2025
I write in connection with your request for information which was received on 7th January 2025 as follows:
I would like to file an FOI request for the following data, pertaining to the Domestic Violence Disclosure Scheme (Clare's Law), for each annual period from 2014* - 2024 inclusive.
Within each period that follows, please could you provide:
How many DVDS requests were received within each period?
How many of those requests within each period were fulfilled?
How many of those requests within each period were rejected?
And, if retrievable, reason(s) for rejection?
The periods in question are from 01 January to 31 December (inclusive) within each year 2014 - 2024 (2014, 2015, 2016, 2017, 2018, 2019, 2020, 2021, 2022, 2023, 2024).
For example, in 2014, between 01 Jan - 31 Dec inclusive, X DVDS requests were received, X were fulfilled, X were rejected. Of those rejected, X number were rejected owing to X reason, and X were rejected owed to X reason.
*Or as the scheme was implemented – please specific
On 9th January 2025 the following clarification was requested:
Please can you confirm that your request relates to 'Right to Ask' applications only (and does not include Right to Know).
Please be advised that information in relation to reasons as to why disclosures were not made is not held in a readily retrievable format. There is no way of readily identifying the reason a Domestic Violence Disclosure Scheme application did not result in a disclosure. In order to determine a response to this element of the request would require individually reviewing each and every non-crime investigation – DV Disclosure Scheme – Right to Ask and the work involved will exceed the cost threshold (£450), which equates to 18 hours work at a standard rate of £25 per hour, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
Please advise if you wish to withdraw this element of your request.
Further, please note that due to system changes, annual information is only available from 2018 onwards, please confirm that you are happy to continue with your request based on 2018 onwards.
On 9th January 2025 you advised:
Yes, I am happy to proceed pertaining to 'Right to Ask' only, and to withdraw 2014-2017 and receive from 2018 onwards.
On 9th January 2025 the following additional clarification was requested:
We also advised in our previous email that there is no way of readily identifying the reason a Domestic Violence Disclosure Scheme application did not result in a disclosure without reviewing each and every record on an individual basis and that, to do so, would exceed the cost threshold (£450), which equates to 18 hours work at a standard rate of £25 per hour, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
