FREEDOM OF INFORMATION REQUEST REFERENCE NO: 805-2025
I write in connection with your request for information which was received on 6th August 2025 as follows:
I would like to make an FOI request to find out the number of drivers that have received fines for driving without a valid MOT certificate.
I would like the data to include how much money the fine was for and whether the fine has been paid or if it was dismissed.
Please provide data for the last 12 months (July 2024 – August 2025).
Please find the Warwickshire Police response set out below.
Response: For the 12-month period 1st July 2024 – 30th June 2025, 256 penalty notices were issued for the offence of ‘Driving Without a Valid MOT Certificate’.
Of these:
163 penalty notices have been paid.
53 have been processed for court.
22 have been cancelled
18 are still in progress.
Please be advised that the offence of Driving Without a Valid MOT Certificate carries a penalty of £100. All revenue from Penalty Notice fines is collected by the Fixed Penalty Officer, HMCTS, and goes to the Treasury, and not to Warwickshire Police. If a driver elects a court hearing, as opposed to complying with the conditional offer, depending on the outcome, the courts could impose a lower or higher fine or dismiss the case. In addition, if the driver defaults, then enforcement is carried out by HMCTS, and the fine may then increase from the original amount imposed. Warwickshire Police do not ‘hold’ the information relating to court outcomes.
Please note that the numerical data presented in this response is an un-audited snapshot of un-published data sourced from "live" systems and is subject to the interpretation of the original request by the individual extracting the data.
Every effort has been made to ensure that the information provided is as accurate as possible; however, the data is subject to the inaccuracies inherent in any large-scale recording system that relies on manual input, therefore care should be taken to ensure data collection processes, and their inevitable limitations are considered when interpreting the data.
Your attention is drawn to the below which details your right of complaint.
Should you have any further enquiries concerning this matter, please write or email the Freedom of Information Unit quoting the reference number above.
Yours sincerely
