FREEDOM OF INFORMATION REQUEST REFERENCE NO: 468-2025
I write in connection with your request for information which was received on 24th April 2025 as follows:
1a. How many resolutions were logged as out of court disposals?
1b. What proportion did community resolutions logged as out of court disposals make up of total out of court disposals for each year?
3a. If possible, please provide a breakdown by offence type if possible.
3b. If possible, please provide how many of these were on the grounds that the alleged offender was misinformed or misled by officers regarding what a community resolution means when agreeing to community resolution. e.g. how it may show up on a full DBS search.
Please find the Warwickshire Police response set out below.
Response: Please be advised that the requested information in relation to Q1a, Q1b and Q2 is not available in a readily retrievable format. The business area conducted a search for all investigations with a Type 8 outcome ‘Community Resolution’, recorded during the period 1st January 2018 to 31st December 2024. This returned a total of 2830 investigations and they have advised that, in order to determine the number of those which were out of court disposals, and the number rescinded, it would be necessary to manually review each and every investigation on an individual basis. The business area has advised that this would take between approximately 5 minutes per investigation and therefore searches would exceed the cost threshold of £450, which equates to 18 hours work at a standard rate of £25 per hour, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. And estimate of the time involved is set out below:
2830 @ 5 mins per investigation = 14150 / 60 = 236 hours
In accordance with Section 12(1) of the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request and, if one part of a request exceeds the fees limit, then section 12 of the Act applies to the whole request.
In accordance with Section 16 of the Act, I have a duty to provide advice and assistance in relation to refining your request and can suggest that, were you to remove Q1a, Q1b and Q2, it may be possible to provide a response to the remaining questions within the fees limit should you wish to resubmit a request:
