I write in connection with your request for information which was received on 8th July 2024 as follows:
I would like to know if Warwickshire police work to NPCC Guidelines of posted speed limit plus 10% plus 2, when travelling on the motorway at 70mph around junction 3a of the M6.
For example: whilst travelling on the motorway (70mph speed limit) then following the NPCC Guidelines plus 10% plus 2 would mean you can travel at 79mph without being prosecuted. And only prosecuted when exceeding 79mph?
Please find the Warwickshire Police response set out below.
Response: I can advise that Warwickshire Police work to NPCC Guidelines and, in accordance with those guidelines, enforcement takes place when a driver exceeds the speed limit by 10% over the speed limit plus 2mph. A Notice of Intended Prosecution (NIP) would be issued on the plus 2mph. ie in a 30mph speed limit, the speed at which a NIP would be issued under this guidance is 35mph, in a 70mph limit it would be at 79mph.
