FREEDOM OF INFORMATION REQUEST REFERENCE NO: 15-2024
I write in connection with your request for information which was received on 4th January 2024 as follows:
Please find the Warwickshire Police response set out below.
Response: Please be advised that the information requested at Q2 and Q3 of your request is not held centrally and is therefore not available in a readily retrievable format. The system which records vehicle seizures does not hold the specific circumstances which led to the seizure, nor any subsequent enforcement measures which may have been imposed. Such information may be held on other systems, for example the Command & Control System in the event that a call was made reporting a vehicle; however, it would be necessary to cross reference each and every seizure with those other systems to determine whether information is recorded. Due to the number of seizures per year (for example there were 1680 for 2023 alone) such searches would take an inordinate amount of time and would exceed the amount to which we are legally required to respond, i.e., the cost of locating and retrieving the information exceeds the ‘appropriate level’, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
In accordance with section 12(1) of the Freedom of Information Act 2000, this letter is a Refusal Notice for this part of the request, and, if one part of a request exceeds the fees limit, then section 12 of the Act applies to the whole request.
In accordance with Section 16 of the Act, I have a duty to provide advice and assistance in relation to refining your request; however, due to the extent of the searches required I am unable to suggest a way to revise these elements of the request into ones which could be provided within the fees limit.
I can advise that it would be possible to provide a response to Q1 and Q2a, and we would also be able to provide a breakdown of the recorded reason for seizure ie ‘no insurance’, ‘’no MOT’ etc, should you wish to resubmit your request on this basis.
Every effort has been made to ensure that the information provided is as accurate as possible.
