FREEDOM OF INFORMATION REQUEST REFERENCE NO: FOI-249-2024
I write in connection with your request for information which was received on 27th February 2024 as follows:
How many people detained under UK immigration legislation powers have been held in your force's police cells from 01 January 2022 to 31 January 2024?
Please disaggregate by police station and by length of detention, using the following lengths of detention:
Of those held:
Please accept my sincere apologies for the delay in providing the response to your request and for any inconvenience that this may have caused you. Please find the Warwickshire Police response set out below.
Response: Please be advised that much of the requested information is not centrally recorded and is therefore not held in a readily retrievable format. Whilst there is a report generated for the purpose of reimbursement from the Home Office in relation to detentions under immigration powers, the information contained therein is limited. Therefore, in order to determine information in relation to release conditions and transfers it would be necessary to cross reference and manually review the custody record for each individual detained. Further, prior to April 2023, the report did not capture the total time that a detainee is held in a police cell under immigration, and those records would also require individually examining to calculate the time. The business area has advised that, during the period 01/01/2022 to 31/01/2024, there were 159 individuals detained in relation to immigration offences, and, at a conservative estimate of 10 minutes per record to review, this would equate to in excess of 26 hours work. Therefore, this would exceed the cost threshold of £450, which equates to 18 hours work at a standard rate of £25 per hour, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
In accordance with Section 12(1) of the Freedom of Information Act 2000, this letter is a Refusal Notice for this part of the request, and, if one part of a request exceeds the fees limit, then Section 12 of the Act applies to the whole request.
In accordance with Section 16 of the Act, I have a duty to provide advice and assistance in relation to refining your request and can advise that should you wish to revise your request, it may be possible to provide, within the fees limit, the number of individuals, since April 2023, disaggregated by police station and by length of detention, using the following lengths of detention:
Every effort has been made to ensure that the information provided is as accurate as possible.
Your attention is drawn to the below which details your right of complaint.
Should you have any further enquiries concerning this matter, please write or email the Freedom of Information Unit quoting the reference number above.
