FREEDOM OF INFORMATION REQUEST REFERENCE NO: 1120-2024
I write in connection with your request for information which was received on 24th December 2024, and clarification received on 6th January 2025, as follows:
I am requesting a set of specific, discrete data, please.
As of 19 December 2024:
(1) How many allegations that have been made to your police force have also been made on the website Everyone’s Invited (https://gbr01.safelinks.protection.outlook.com/?url=http%3A%2F%2Fwww.everyonesinvited.uk%2F&data=05%7C02%7CFreedom.Information%40warwickshire.police.uk%7C6ddc80f9d3444b060c3008dd242272c5%7Ca324afb60aef47f7a287982ba7311d8a%7C0%7C0%7C638706452564923344%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=Xq07gj7pu9XmElK4IAILFYnXY0DMtTGIbcaswGNjR5k%3D&reserved=0) i.e. how many allegations made to your police force have a dedicated Everyone’s Invited 'flag' (or other categorisation linking the allegation to Everyone's Invited)?
(2) Out of that total number of allegations in (1), how many:
(a) resulted in a police investigation;
(b) resulted in a suspect being charged with an offence(s); and
(c) of the total number of suspects charged in (b):
Clarification received on 6th January:
I would like the data to reflect any allegations of offences contrary to the Sexual Offences Act 2003.
Please use this date range: 1 June 2020 to 19 December 2024 (inclusive).
Please find the Warwickshire Police response set out below.
Response: Please be advised that Warwickshire Police do not hold information with regard to what is contained within the Everyone’s Invited website, and there is no flag or marker in existence within the Crime Recording System which would denote a link to an allegation on the Everyone’s Invited website. If any recorded information is held that allegations of an offence recorded by Warwickshire Police has also been mentioned on the Everyone’s Invited website, this would be within the wider documentation of an investigation.
Section 1 of the Freedom of Information Act 2000 places two duties on public authorities. Unless exemptions apply, the first duty at Section 1(1)(a) is to confirm or deny whether the information specified in a request is held. The second duty at Section 1(1)(b) is to disclose information that has been confirmed as being held.
Warwickshire Police are unable to confirm whether or not any reference is made within any investigation relating to an offence under the Sexual Offences Act 2003, that an allegation has been made on the Everyone’s Invited website and Section 12(2) applies.
Section 12(2) states: “…Subsection (1) does not exempt the public authority from its obligation to comply with paragraph (a) of section 1(1) unless the estimated cost of complying with that paragraph alone would exceed the appropriate limit.”
In order to determine if such information is or is not held and, if held, to ensure that all information is located, it would be necessary to review each and every offence on an individual basis. As you will appreciate, this would take an inordinate amount of time and, therefore, the cost of complying with paragraph (a) of section 1(1) would be above the amount to which we are legally required to respond i.e. the cost of exceeds the ‘appropriate level’ as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
In accordance with Section 12(2) of the Freedom of Information Act 2000, please treat this letter as the Refusal Notice I am required to provide to you in respect of your request.
In accordance with Section 16 of the Act, I have a duty to provide advice and assistance in relation to refining your request. However, due to the extent of the searches required, I am unable to suggest a way to revise this element of your request into one which could be provided within the fees limit.
Every effort has been made to ensure that the information provided is as accurate as possible.
Your attention is drawn to the below which details your right of complaint.
Should you have any further enquiries concerning this matter, please write or email the Freedom of Information Unit quoting the reference number above.
Yours sincerely
