FREEDOM OF INFORMATION REQUEST REFERENCE NO: FOI-770-2024
I write in connection with your request for information which was received on xx as follows:
Please could you provide the custody records for arrests under sections 12 and 14 of the Public Order Act 1986 alongside, in each case:
- the age grouping of the persons arrested
- the gender of the persons arrested and
- the ethnicity of the persons arrested.
Please could you provide the requested information for both of the following time periods: January 2017 – May 2022 (inclusive) and June – July 2024 (inclusive).
Please could you also provide the custody records for arrests under:
- the age grouping of the persons arrested
- the gender of the persons arrested and
- the ethnicity of the persons arrested.
Please find the Warwickshire Police response set out below:
Response: Please be advised that the requested information is not centrally recorded and is therefore not held in a readily retrievable format. ‘Reason for Arrest’ for Public Order offences are all stated as ‘Public Order’. In order to determine whether the specific offences listed are relevant it would be necessary to review the arrest circumstances and associated investigations for each and every ‘Public Order’ arrest (please further note that this information may not always be mentioned). An estimate of the cost involved in undertaking these searches is set out below:
1929 @ 3 to 5 mins = 5787 to 9645 minutes / 60 = 96 hours to 161 hours
This would therefore exceed the amount to which we are legally required to respond, i.e., the cost of locating and retrieving the information exceeds the ‘appropriate level’, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. For Police forces in the UK, the "appropriate limit" is up to 18 hours of work on one request.
In accordance with section 12(1) of the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this request.
Under Section 16 of the Act, I have a duty to provide advice and assistance; however, in this instance, I am unable to suggest a way that you could reasonably pare down your request into one which could be handled within the fees limit.
Every effort has been made to ensure that the information provided is as accurate as possible.
