I write in connection with your request for information which was received on 28th September 2023 as follows:

Please find the Warwickshire Police response set out below. Please note that the response is based on the number of firearms offences for which under 18s were arrested during the stated period. Please note that one individual may have been arrested for more than one offence.

Q2 response: Section 17 of the Freedom of Information Act 2000 requires Warwickshire Police, when refusing to provide information (because the information is exempt) to provide you the applicant with a notice which:
The following exemption is applicable to some of the information requested:
Section 40(2) – Personal Information
Section 40 is an absolute exemption which does not require me to evidence the harm that disclosure would cause and does not require consideration of a public interest test in justification of its use.
This exemption is engaged where disclosure of information could lead to the identification of an individual, either from that information alone or combined with other information from within the Police Service or public domain. Exemption under Section 40(2) is applicable where the information requested relates to a third party or could lead to the identification of an individual which would be a breach under the Data Protection Act 2018, in particular Article 5(1) of the GDPR which states that personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject.
In this case, due to low numbers, providing information broken down by exact age of the suspects is highly likely to identify an individual and, for this reason, information with regard to age has been provided in an age band.
