When I refer to sexting I am seeking to secure data on cases which relate to the distribution of an indecent photograph / pseudo-photograph of a child.
Please find the Warwickshire Police response set out below. When reviewing the information please note that it was obtained by searching for all offences of 86/02 ‘Take or to make or to distribute indecent photographs or pseudo- photographs, of children’, recorded between 1st January 2019 and 31st December 2022, where the suspect is aged 18 or under.

Section 40(2) – Personal Information
Section 40 is an absolute exemption which does not require me to evidence the harm that disclosure would cause and does not require consideration of a public interest test in justification of its use.
This exemption is engaged where disclosure of information could lead to the identification of an individual, either from that information alone or combined with other information from within the Police Service or public domain. Exemption under Section 40(2) is applicable where the information requested relates to a third party or could lead to the identification of an individual which would be a breach under the Data Protection Act 2018, in particular Article 5(1) of the GDPR which states that personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject.
In this case, due to low numbers, providing information broken down by year and exact age of those charged is highly likely to identify an individual and, for this reason, information with regard to age has been provided across the entire period and in age bands.
