FREEDOM OF INFORMATION REQUEST REFERENCE NO: 948-2023
I write in connection with your request for information which was received on 13th October 2023 as follows:
Police complaints Statistics for England and Wales 2022/23 (Experimental statistics)
'Table 14: Means by which allegations were finalised in 2022/23'
reveals that:
92 allegations (13%) relating to Warwickshire Police were finalised 'Under Schedule 3 - investigated'
'Table 16: Allegations finalised by investigation under Schedule 3 in 2022/23'
reveals that:
90 were 'Investigated (not subject to special procedures)'
and that:
2 were 'Investigated (subject to special procedures)'.
Please provide brief details of each of the 2 allegations in the latter category and the outcome of your investigations.
Response: Please be advised that the requested information is not centrally recorded and is therefore not held in a readily retrievable format. It is not possible to retrospectively identify the 2 cases mentioned without reviewing the details of each and every complaint recorded in 2022/23. I can advise that this equates to 707 cases and at between 5 and 10 minutes per complaint, this would exceed the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. An estimate of the cost involved is set out below:
707 complaints @ 5 minutes per complaint (minimum) = 3535 minutes = 59 hours
In accordance with s12(1) of the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this request.
In accordance with Section 16 of the Act I have a duty to provide advice and assistance; however, due to the number of records which would need to be individually reviewed, I am unable to suggest a way to reduce your request into one which could be managed within the fees limit.
Every effort has been made to ensure that the information provided is as accurate as possible.
Your attention is drawn to the below which details your right of complaint.
Should you have any further enquiries concerning this matter, please write or email the Freedom of Information Unit quoting the reference number above.
Yours sincerely
