FREEDOM OF INFORMATION REQUEST REFERENCE NO: 1068-2023
I write in connection with your request for information which was received on 21st November 2023 as follows:
Please provide the data regarding the Domestic Violence Disclosure Scheme (also known as Clare’s Law). For this request, please provide the following data from 2014 up until the most current date available at the point of production. If data as early as 2014 is not available, please provide it from the first available date onwards.
- The number of ‘right to know’ applications
- The number of ‘right to ask’ applications
2. If available, please also provide annual totals of:
- The number of ‘right to know’ applications which resulted in disclosure after 28 days, and the number which resulted in disclosure after 35 days.
- The number of ‘right to ask’ applications which resulted in disclosure after 28 days, and the number which resulted in disclosure after 35 days.
3. Additionally, if available, please also provide:
- For each year, the longest time it took for a ;right to ask' disclosure to be provided
- For each year, the longest time it took for a 'right to know' disclosure to be provided
Please accept my sincere apologies for the delay in providing the response to your request and for any inconvenience this may have caused you. Please find the Warwickshire Police response set out below.
When reviewing the information please note that,
Response: Please be advised that some of the requested information is not centrally recorded and is therefore not held in a readily retrievable format. In order to determine the information requested in Q2 and Q3 it would be necessary to individually review each and every record on an individual basis. I can advise that, due to changes in systems, it is not possible to retrieve annual information prior to 2018; therefore, searches were conducted for all DVDS non-crime investigations, recorded within the period 01/01/2018 and 21/11/2023 (the date of the request). This produced a total of 1190 records and even at a conservative estimate of 2 minutes per record, the work involved in locating and retrieving the requested information for Q2 and Q3 will exceed the cost threshold (£450), which equates to 18 hours work at a standard rate of £25 per hour, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
In accordance with Section 12(1) of the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request, and, if one part of a request exceeds the fees limit, then Section 12 of the Act applies to the whole request.
In accordance with Section 16 of the Act, I have a duty to provide advice and assistance in relation to refining your request: however, due to the volume of records that would need to be reviewed am unable to identify information that could be supplied within the fees limit for this element of your request.
Outside of the Act and as a gesture of goodwill I have provided information in relation to Q1 as this was retrieved before it was realised that the fees limit would be exceeded. This should not be taken as a precedent that additional information would be supplied outside of the time/fees legislation for any subsequent requests.

In order to determine whether the 55 cases under the ‘Non-Crime - DVDS’ classification actually relate to ‘Right to Ask’ or ‘Right to Know’, it would be necessary to examine each record on an individual basis.
