FREEDOM OF INFORMATION REQUEST REFERENCE NO: FOI-1049-2023
I write in connection with your request for information which was received on 15th November 2023 as follows:
Please accept my sincere apologies for the delay in providing the response to your request and for any inconvenience this may have caused you. Please find the find the Warwickshire Police response set out below.
Response: Section 12(1) of the Freedom of Information Act states that a public authority is not obliged to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the “appropriate limit”. For Police forces in the UK, the "appropriate limit" is considered to be up to 18 hours of work on one request. This information is given in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
Please be advised that the information that you have requested is not available in a readily retrievable format. The information is not held centrally or in an electronically retrievable format. There is no identifier within the Command & Control System to determine such information; however, in order to provide assistance, a search was carried out for all incidents, recorded during the stated period, which mention the words ‘unlicensed’, ‘event’, ‘music’, ‘rave’ or ‘party’ within the log text. This returned 36,586 results and in order to determine whether any of those fall within the criteria of your request, it would be necessary to review each and every one on an individual basis. Such searches would exceed the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the ‘appropriate level’ (18 hours/£450) as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. An estimate of the cost involved is set out below:
36,586 x 4 minutes = 2439 hours
In accordance with Section 12(1) of the Freedom of Information Act 2000, this letter is a Refusal Notice for request.
In accordance with Section 16 of the Act I have a duty to provide advice and assistance and, if possible, suggest ways in which you may revise your request; however, due to the volume of information concerned, I am unable to suggest a way to revise the request into one which could be provided within the fees limit.
Every effort has been made to ensure that the information provided is as accurate as possible.
Your attention is drawn to the below which details your right of complaint.
Should you have any further enquiries concerning this matter, please write or email the Freedom of Information Unit quoting the reference number above.
Yours sincerely
