FREEDOM OF INFORMATION REQUEST REFERENCE NO: FOI-1010-2023
I write in connection with your request for information which was received on 2nd November 2023 as follows:
The primary objective of this report is to conduct an in-depth examination of the legal landscape and the rate of accidents involving Automated Teller Machines (ATMs).
In light of this, we formally request your assistance in providing us with the following critical data and information, where feasible, to facilitate our comprehensive analysis:
Please accept my sincere apologies for the delay in providing the response to your request and for any inconvenience this may have caused you. Please find the Warwickshire Police response set out below.
Response: Please be advised that information requested at Q2 is not centrally recorded and is not available in a readily retrievable format. There is no specific identifier within the Crime Recording System for ‘ATM attacks’. In order to provide assistance the analyst searched the system for all offences, recorded between 1st January 2019 and 31st December 2022, which mention one of the following keywords within the MO Description of the crime: ‘ATM’, ‘cashpoint/cash point’, ‘cashmachine/cash machine’. This search returned 1040 results and in order to ascertain whether the offence related to an attack on an ATM and if so, to obtain the remaining information requested, it would be necessary to examine each and every record on an individual basis. Such searches would exceed the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the ‘appropriate level’ (18 hours/£450) as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. An estimate of the cost involved is set out below:
1040 x 4 minutes = 69 hours
In accordance with Section 12(1) of the Freedom of Information Act 2000, this letter is a Refusal Notice for this part of the request, and, if one part of a request exceeds the fees limit, then Section 12 of the Act applies to the whole request.
In accordance with Section 16 of the Act I have a duty to provide advice and assistance; however, due to the volume of information concerned, I am unable to suggest a way to pare down this element of your request into one which could be provided within the fees limit.
I can advise that it may be possible to provide information for Q1 and Q3 of your request; however, please be aware that any information, if held, may be subject to exemptions.
Every effort has been made to ensure that the information provided is as accurate as possible.
Your attention is drawn to the below which details your right of complaint.
Should you have any further enquiries concerning this matter, please write or email the Freedom of Information Unit quoting the reference number above.
Yours sincerely
