I write in connection with your request for information which was received on 4th July 2023 as follows:
For clarity, references above to 'consensual child sexting' refer to any offence under s.1 of the Protection of Children Act 1978 or s.160 of the Criminal Justice Act 1988 committed (or alleged against) a child where the subject of the indecent image made, distributed or possessed consents to the offence and is also a child. At the material times, such offences were 'counted' under Home Office Counting Rules as offences 86/02 and 86/10.
Please kindly confirm whether the requested information is being provided in full or in part in your response, identifying which elements (if any) are not provided. In particular, please identify whether your response includes only 'consensual' offences or whether you have been unable to filter on the basis of consent.
Please additionally note that if you are unable to provide data relating to 'consensual' offences (e.g., due to s.12 FOIA considerations), please instead provide the concurrent data relating to the two relevant offence codes and confirm that these are not filtered in respect of consent.
Please find the Warwickshire Police response set out below. When reviewing the information please note that it was obtained by searching for all offences under HOCR codes 86/02 and 86/10, recorded between 1st January 2019 and 31st December 2022, where the suspect/s is under the age of 18. Please be advised that it is not possible to filter offences based on consent.
The resulting records were then filtered to show only outcomes of the specified types. Please note that investigation outcomes only show the most serious outcome for any suspect attached to a crime. In the event that there are multiple suspects attached to one crime, this does not take into account ‘lesser’ or like outcomes of any other suspect(s) ie there is one outcome per crime regardless of whether or not there are multiple suspects.
