FREEDOM OF INFORMATION REQUEST REFERENCE NO: 1112-2023
I write in connection with your request for information which was received on 8th December 2023 as follows:
Please could I have a breakdown of the following information.
In the years:
2014
2015
2016
2017
2018
2019
2020
2021
2022
2023 (January to September 1)
How many times in your force area has a dispersal order under section 34 of the Anti-Social Behaviour, Crime and Policing Act 2014 been ordered?
Please find the Warwickshire Police response set out below.
Response: There were 3 dispersal orders issued in 2022 and 14 issued between 1st January and 31st August 2023.
Regarding the period prior to 2022, information relating to dispersal orders was not centrally recorded and is therefore not held in a readily retrievable format. In order to determine a response to this part of the request, it would be necessary to make enquiries with multiple teams and units within Warwickshire Police who would then be required to conduct searches of all systems, documentation and communication held. As you will appreciate, this would take an inordinate amount of time, and therefore this part of the request would exceed the amount to which we are legally required to respond, i.e., the cost of locating and retrieving the information exceeds the ‘appropriate level’, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. For Police forces in the UK, the "appropriate limit" is up to 18 hours of work on one request.
In accordance with Section 12(1) of the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request.
In accordance with Section 16 of the Act, I have a duty to provide advice and assistance in relation to refining your request; however, due to the volume of records that would need to be reviewed, I am unable to suggest a way to revise this part of your request into one which could be provided within the fees limit.
Every effort has been made to ensure that the information provided is as accurate as possible.
Your attention is drawn to the below which details your right of complaint.
Should you have any further enquiries concerning this matter, please write or email the Freedom of Information Unit quoting the reference number above.
Yours sincerely
