FREEDOM OF INFORMATION REQUEST REFERENCE NO: 385-2023
I write in connection with your request for information which was received on 10th April 2023 as follows:
For the years 2020, 2021 and 2022 (Jan 1st - Dec 31st), can you please provide me with details of the actions taken, after reviewing the video submissions made by third parties, in relation to the following?
A, For the above years, how many submissions were made, alleging the offence of careless driving when passing cyclists (more commonly known as close pass reports)?
B, Of the submissions, detailed in question A, what results were taken against the accused? How many NIPs were issued etc
C, For the above years, how many submission were made, alleging the use of a handheld device/mobile phone whilst driving?
D, Of the submissions, detailed in question C, what results were taken against the accused? How many NIPs were issued etc
E, For the above years, how many submission were made, alleging other offences than close pass and the use of a handheld device/mobile phone whilst driving?
F , Of the submissions, detailed in question E, what results were taken against the accused? How many NIPs were issued etc
Please accept my sincere apologies for the delay in providing the response to your request and for any inconvenience this may have caused. Please find the Warwickshire Police response set out below.
Response: Please be advised that some of the requested information is not held in a readily retrievable format. In relation to QB, D and F, for the year 2020, information relating to actions taken is not centrally recorded, due to different recording methods used at that time. Therefore, in order to answer these questions for 2020, it would be necessary to individually review each and every offence to determine what action was taken. The business area has advised that in 2020, there were 1,120 offences recorded following video submissions by third parties (incorporating close pass, use of mobile phone and any other offences). At an estimate of 3 minutes per offence to review, this would equate to over 55 hours of work, and would therefore exceed the amount to which we are legally required to respond, i.e., the cost of locating and retrieving the information exceeds the ‘appropriate level’, as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. For Police forces in the UK, the "appropriate limit" is up to 18 hours of work on one request.
In accordance with Section 12(1) of the Freedom of Information Act 2000, this letter is a Refusal Notice for this part of the request, and, if one part of a request exceeds the fees limit, then Section 12 of the Act applies to the whole request.
In accordance with Section 16 of the Act, I have a duty to provide advice and assistance in relation to refining your request. Due to lower numbers in the results, it may be possible to provide some information in relation to QB and QD, for the year 2020, if you were to revise and resubmit your request removing QF.
As a gesture of goodwill, I have provided the responses to the remaining questions below, along with responses to QB, D and F, for years 2021 and 2022. This data was located before it was realised that not all of the information could be retrieved within the fees limit and should not be taken as a precedent that additional information would be supplied outside of the time/fees legislation for any subsequent requests.
