FREEDOM OF INFORMATION REQUEST REFERENCE NO: FOI 88-2022
I write in connection with your request for information which was received on 27th January 2022 as follows:
Q1. For each calendar year from 2016 up to and including 2021, how many people have been arrested for Loitering or Soliciting for Prostitution? Please provide a breakdown of gender and race.
Q2. For each calendar year from 2016 up to and including 2021, how many people have been arrested for keeping a brothel? Please provide a breakdown of gender and race.
Q3. For each calendar year from 2016 up to and including 2021, how many people have been arrested for paying for the sexual services? Please provide a breakdown of gender and race. (Applicant has confirmed that they are only after information for prostitution related offences).
Q4. For each calendar year from 2016 up to and including 2021, how many people have been arrested “Kerb Crawling”? Please provide a breakdown of gender and race.
Q5. For each calendar year from 2016 up to and including 2021, how many people have been arrested for having sex with a trafficked person, according to Section 14 of the Policing and Crime Act 2009, which created a summary-only offence of paying for the sexual services of a prostitute subjected to force
I apologise for the delay in responding to your request under the Freedom of Information Act. I can confirm that your request has now been processed and my response is below.

Q1 – No information held
Q2 - I can advise that information is held, however, I am unable to provide all of the information requested.
Section 17 of the Freedom of Information Act 2000 requires Warwickshire Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which:
The following exemption is applicable to the information requested:
Section 40 – Personal Information
Section 40(2) is an absolute exemption which does not require me to evidence the harm that disclosure would cause and does not require consideration of a public interest test in justification of its use.
This exemption is engaged where disclosure of information could lead to the identification of an individual, either from that information alone or combined with other information from within the Police Service or public domain.
In this case, due to the very low number, releasing the information is likely to identity individuals. Such a disclosure would breach those individuals’ rights under the Data Protection Act 2018, in particular Article 5(1) of the GDPR which states:
“1. Personal data shall be:
(a) processed lawfully, fairly and in a transparent manner in relation to the data subject (‘lawfulness, fairness, transparency’)”
In accordance with Section 17(1) of the Act this letter represents a partial refusal notice in respect of the monthly breakdown for the entire period.
Information I am able to provide is set out below:
One arrest was made during this period for the offence of Keep / manage a brothel used for prostitution.
Q3 – No information held.
Q4 - This is a repeated question from Q1 as this would come under “Person persistently solicit for the purposes of prostitution”
Q5 – No information held.
