FREEDOM OF INFORMATION REQUEST REFERENCE NOs: West Mercia Police 11513 and Warwickshire Police 11514
I write in connection with your requests for information which were received on 26th March 2019. Please find below the responses to your requests for West Mercia Police and Warwickshire Police information:
I would like to find out whether the force has any punitive measures in place specifically for people caught having sex in parks or public spaces. This might include measures such as fines or tickets, for example.
If it does, please could you disclose how many such measures you have handed out to date, and, if possible, according to the year?
For clarity, I am asking about specific measures which you may have that target people who have sex in parks and/or public spaces, and not about punishment for offences which might cover this type of act (such as outraging public decency).
REPLY:
The Alliance can confirm the offence of outraging public decency is not a fixed penalty offence.
The offence would be charged by the Police or CPS depending on the plea and prosecuted through the Court system
