FREEDOM OF INFORMATION REQUEST REFERENCE NOs: West Mercia Police 11177 and Warwickshire Police 11178
I write in connection with your requests for information which were received on 5th February 2019. Please find below the responses to your requests for West Mercia Police and Warwickshire Police information:
1) how many people have been given on the spot penalties for tailgating in the calendar years 2017 and 2018
2) Could you provide the name of the road where the most tailgating offences were recorded during this period as a whole and the number of offences recorded
West Mercia Police 11177 and Warwickshire Police 11178 REPLY: Please be advised that the information that you have requested is not available in a readily retrievable format.
There is no offence of tailgating. It would be recorded under due care. There is no way of knowing if the allegation refers to someone tailgating without locating, retrieving & reviewing each individual file.
The Traffic Manager has calculated that each file would take an average of 10 minutes to locate, retrieve and review. There are 504 due care files for West Mercia for 2017 & 2018 & 249 due care files for Warwickshire for 2017 & 2018, so this time would exceed 18hr limit for FOI requests.
We would need to identify which cases involved tailgating before we could respond to the second question. As we are unable to respond to Q1 within the FOI time restrictions, we are unable to respond to Q2.
Therefore the cost of providing you with the information is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the 'appropriate level' as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
In accordance with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this request
