Aim
To give the students an introduction to the offences, powers and the use of such powers relating to the Harassment Act 1997

Objectives
By the end of the course the students will be able to.

  • State the definition of the offence of harassment, contrary to Section 2(1) of the Protection from Harassment Act 1997
  • Explain the meaning of ‘course of conduct’ as it applies to the Act
  • Explain the meaning of ‘harassment’ as it applies to the Act
  • Explain the three defences for an offence contrary to Section 2 of the Protection from Harassment Act 1997
  • State the definition of putting people in fear of violence, contrary to Section 4(1) of the Protection from Harassment Act 1997
  • Explain the points to prove for an offence contrary to Section 4(1) of the Protection from Harassment Act 1997
  • Explain the three defences for an offence contrary to Section 4(1) of the Protection from Harassment Act 1997
  • Explain the police power to deal with an offence of harassment, contrary to Section 2(1) of the Protection from Harassment Act 1997
  • Distinguish between offences of ‘harassment’ and ‘putting people in fear of violence’, contrary to the Protection from Harassment Act 1997
  • Outline the meaning and purpose of a restraining order
  • State the police power to deal with a breach of a restraining order, contrary to Section 5(5) of the Protection from Harassment Act 1997
  • Outline the meaning and purpose of a ‘non-harassment’ injunction
  • Apply the legislation to relevant scenarios
  • Identify the effects and consequences this type of offence may have on the more diverse members of the community.
